How to Make a Judicial Referral

Any member of the University community such students, faculty or staff members may file a judicial referral to the Office of Judicial Affairs. In the cases involving alleged violations of the abusive conduct policy, we cannot proceed judicially without the affected student(s) acting as a referral agent bringing the referral forward.

To make a judicial referral, simply complete the judicial complaint form , specifically addressing the behavior(s) that are in violation of the University Code of Conduct. Make sure you sign and date the form and mail or deliver it to the Office of Judicial Affairs(located in University Center 318). The Judicial Complaint Form is available online at: www.tamucc.judicial. Any complaint should be submitted within ninety(90) days after the event takes place or becomes known, within one-year time frame.

Once a referral is filed, the Office of Judicial Affairs will review the referral, assign charges, and contact the charged student(s). The judicial advisor will conduct a pre-hearing conference with the referral agent and with the charged student(s) separately to discuss their rights and responsibilities. The judicial advisor may conduct an investigation to determine if the charges have merit and/or if they can be disposed of administratively by mutual consent of the parties involved in a manner acceptable to the judicial advisor.

 

Referral Agent Rights

The referral agent has the right to:

  • To be assisted by an advisor they choose at their own expense. Counsel is restricted to an advisory role - he/she may not participate directly in any hearing before the judicial body.
  • Bring witnesses who can make statements about the event in question.
  • Refute any evidence or statements presented during the hearing.
  • In cases involving the abusive conduct policy, the option to be notified of the final outcome of the hearing.

 

Referral Agent Responsibilities

The referral agent is expected to:

  • Attend the hearing
  • Provide the Office of Judicial Affairs with a list of witnesses sufficiently in advance of the hearing
  • Notify any witnesses and your advisor of the date and time of the hearing.

The Judicial Hearing

  • Alleged violation(s) are read
  • Referral Agent(s) statement regarding the event(s) in question
  • Questions by charged student(s)
  • Questions by hearing officer or judicial board
  • Charged students(s) statement
  • Questions by Referral Agent
  • Questions by hearing officer or judicial board
  • Witnesses for the referral agent followed by questions
  • Witness for the charged student(s) followed by questions
  • Closing statements
  • Deliberation
  • Outcome is reported to the charged student in written form
